Vitello Productions, Inc. (“Company”) is committed to respecting the privacy rights of all of the visitors to the Z-Force website (“Z-Force”). This privacy policy (“Privacy Policy”) sets forth what personal and usage information we collect, as well as how that information is used, maintained, and in some cases, shared with third parties. This Privacy Policy also sets forth how to contact us if you have any questions about privacy at Z-Force.
Z-Force has been developed to be an entertainment experience for children of all ages. We encourage parents and guardians to participate with their children in the interactive activities on our site.
We are commitment to the privacy of all visitors to our site, especially those under the age of 13. Recognizing that younger children may not fully understand this information and we request you discuss the “Kids Privacy and Safety” page, available here http://www.test.z-force.tv/page/privacy-policy.html, with your children so that they will better understand how to use Z-force.
Special Note to Parents, Legal Guardians, and Visitors Under Age 18
If you are a parent, you should know that Company adheres to the Children’s Online Privacy Protection Act of 1998 regarding the collection of data for visitors under 13. It is very important for you to understand that although we only collect limited personal information from visitors under 13 and only make use of that information as described in this policy. You must help us protect your child’s privacy by actively monitoring your child’s use of Z-Force and by instructing your child to never post personal information on Z-Force without your permission.
If you are a 13 to 17 year old visitor, please be sure to read this policy with your parents or legal guardian and ask questions about anything you do not understand.
If you are a visitor under 13, you must get your parent’s or a legal guardian’s permission in order to register and become a member of Z-Force. Please ask your parents or legal guardian to read this carefully so that they understand how Company will use your personal information, and ask them to help you with the registration process.
Does Company Collect Any Personal Information About Users 13 and Older?
We do not require anyone to share any personal information about themselves in order to visit Z-Force. However, Z-Force contains special sections and privileges for users that register for an account on the site. When you register for an account, we will ask for your first and last name, your screen name (which should not be your full name), your phone number and your e-mail address. We explain below how we will use this information. Z-Force also provides areas where you can choose to disclose additional personal information to other Z-Force users, as described below.
Does Company Collect Any Personal Information About Users Under Age 13?
For children under the age of 13 we require parental permission for the usage of the following activities:
- “Discover your Power Animal” – which allows a child to discover his or her Power Animal based upon the child’s birth date and the Chinese lunar calendar.
- “Share your Power Animal” – which allows a child to share his or her Power Animal with others via an e-mail “post card.” To engage in this activity, the child must know the e-mail address of the person that they are sharing with. We strongly encourage children to share information only with people they know in real life. These post cards will only contain the senders screen name, Z-Force.tv text, graphics, video and or audio information. No personally identifiable information is included.
- Newsletter and Promotions – we may e-mail your child the Z-Force newsletter and with information about any Z-Force promotions, such as contests or new products.
Children can participate in these activities after registering for a free user account through our account system, which all users must complete. When any unregistered or “non-logged in” user selects an activity throughout Z-Force which require any personal information, the user will be blocked form those activities until a user account is set up and activated.
We do not collect personal information online from children under 13 without the express consent of a parent or legal guardian. With your verifiable express consent, we may collect personal information from your child such as a first name, screen name, date of birth, and e-mail address when the information is necessary for a particular activity. If your child attempts to register for Z-Force, we will ask your child for your name and e-mail address so that we can notify you of your child’s request and ask for your permission to collect your child’s first name, date of birth, screen name, and e-mail address. We will automatically e-mail you with notification of the request and instructions how to give permission for and activate your child’s free user account. This e-mail will also tell you how to access your child’s account, for the purpose of reviewing, deleting or “opting out of” these activities at any time. At this time, Z-Force does not technologically allow for changing your child’s account, thus should you want to change your child’s account, you must delete it and create a new account with the changed information. When we ask for your permission, we will tell you what we will do with the information you or your child provides us, and we will tell you how you can review your child’s information and how you can ask us to delete the information. We do not keep your or your child’s information unless you give us permission, other than for the initial registration and consent process. If you do not respond to the consent process in a timely manner, then we will delete your and your child’s information.
If it is ever necessary to collect additional personal information from your child in order for your child to participate in a particular activity, we will notify you, explain what information we need and why, and ask that you (not your child) provide that information. For example, if we offer a contest with prizes, we might ask you for your mailing address so that we can send to you, for your child, any prizes your child wins, or for your telephone number so that we can tell you when your child has won. Any information you or your child give us in the above special circumstances will be deleted from our records once the promotion, program or activity is concluded, and after any legally required period for keeping such information is complete. We do not require a child to disclose more information than is reasonably necessary to participate in a contest, game or other activity as a condition of participation.
Parents will be provided with information on the type of content and activities their child may access at the time they register their child, and are always in charge of their child’s account.
In order to protect the personal information of underage users and insure that only the parent or legal guardian has access to it, we require the parent or legal guardian set up a parent account with their first and last name, e-mail address, phone number and password. Upon proper identification, parents or legal guardians may review the personal information we have collected about their child, request immediate deletion, or refuse to allow further collection or use of personal information about the child by following the directions on the Parent review page, accessible here ________________________ or by contacting us by e-mail at privacy@z-force.tv or by mail at:

Please note in order to protect the security of your child’s information, you will be required to properly identify yourself before we can process such a request.
We may collect your child’s email address and screen name without your consent only under the following circumstances:
- When your child send us a request, we will keep your child’s e-mail address for purposes of responding to them, but will delete your child’s e-mail address as soon as we respond to the request. However, we may keep a copy of the actual communication for legal or archive purposes.
- When we run promotions, such as a contest, we will ask for your child’s e-mail address and screen name, for purposes of entry into the promotion. We will delete this information at the end of the promotion.
What Personal Information does Company Collect when I Make a Purchase at the Z-Force Online Store?
We may offer opportunities to purchase products in our online stores or to subscribe to special services for a fee. In order to purchase products or services, you must be 18 or older. Z-Force users under age 18 will not be able to make purchases.
When a customer places an order online, we collect information associated with the transaction, which will include the customer’s name, mailing address, products ordered, shipping address, and credit card information. This information is transmitted to our online store provider, BigCommerce (a product of Interspire Pty. Ltd.) for purposes of completing the transaction. For more information about BigCommerce’s privacy practices, please see their terms located at http://www.bigcommerce.com/terms.php. The BigCommerce sends your information to our credit authorization company, Authorize.Net (run by CyberSource Corporation), which then sends us the information so that we may fulfill the order. For more information about Authorize.Net’s privacy practices, please see their terms located at http://www.authorize.net/company/privacy/. We then send your information to our third party fulfillment provider, AMS Fulfillment, so that your item(s) may be delivered to you. For more information on AMS Fulfillment, please see their web site located at http://www.amsfulfillment.com
When a customer places an order through the Z-Force store, those transactions are conducted through the third party vendors’ website as described above. You should be sure to review each vendor’s website terms and conditions and privacy policy before submitting any personal information or engaging in any transactions through any third-party website. Company is not responsible for any transactions made through third-party websites or for any content, terms and conditions, or privacy policies of such third-party websites.
Customers have the option of registering certain information for future orders while completing their online order. For customers who choose to register, we will collect their login name, password, full name, billing address, phone number, e-mail address, and where applicable, credit card or other payment account information. When registered customers return to the site to place subsequent orders, they can identify themselves with their login name and password. This Z-Force store account is a different account than the account for Z-Force. The Z-Force store account is solely intended for use in the Z-Force store.
When a customer places an order online, we will send a confirming e-mail message. We may also send an occasional e-mail featuring a special promotion or product that may be of interest to customers. Any customer who prefers not to receive promotional e-mail should indicate this preference on the online store order form. If you receive any e-mails from us that you would rather not receive, simply follow the “unsubscribe” instructions included in the e-mail.
How does Company Use the Personal Information We Collect?
We use your name, address, phone number, and e-mail address for the purpose of communication with you regarding Z-Force, such as for newsletters or for upcoming Z-Force events, products, website updates and promotions. We use your name, phone number, e-mail address and credit card or other billing account type, number, and expiration date for the purpose of billing you for purchases and fulfilling your order. We use the aggregate information we collect to help us understand and better respond to our users’ needs.
How Does Company Maintain the Personal Information We Collect?
We make good faith efforts to provide you with access to your personal information and delete your information at your request if it is not otherwise required to be retained by law or for legitimate business purposes. At this time, Z-Force does not technologically allow for the changing of your information, thus should you want to change your information, you must delete it and create a new account with the changed information. The security and confidentiality of your personal information is important to us and we will take reasonable measures to protect it, including measures to protect against unauthorized access, alteration, and disclosure. These security measures include, for example, internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.
When the use of Z-Force involves the transmission of personal information through a purchase on the Z-Force store, we use Secure Socket Layer (SSL) technology to establish a secure connection between your computer and the Z-Force store. SSL allows for the transmission of encrypted information from your computer to the Z-Force store and back again, and is currently one of the industry standards for Internet platform security. From time to time, we review our security procedures in order to consider new technologies and methods.
Please be aware that no data transmission over the Internet can be guaranteed to be 100% secure, so while Company strives to protect your personal information, Company cannot ensure or warrant the security of any information that you voluntarily give to us.
Company also monitors all network traffic to Z-Force to identify and/or block unauthorized attempts or intrusions to upload or change information or cause damage to Z-Force in any manner, including any Z-Force user accounts.
When Does Company Share Personal Information with Third Parties?
We do not share your personal information with any third parties for any purposes except in limited circumstances where we believe such sharing is (1) legally required or done to comply with a request from a government agency, (2) done in order to provide and maintain Z-Force, (3) done in conjunction with a corporate restructuring, (4) done to protect against fraud or other damage to Z-Force or to other users of Z-Force, or (5) otherwise permitted by you. For example:
- As described above, we may provide personal information to commerce, payment and fulfillment service providers when you conduct transactions through the Z-Force store. As described above, the third-party service provider’s privacy policy will apply to data communicated during these transactions.
- We may provide personal information to trusted service provider partners who are providing internal support services (“Internal Support Services Partners”) that help us provide and maintain Z-Force. In connection with this, our Internal Support Services Partners may have access to your personal information for a limited time. When we provide information to Internal Support Services Partners, we implement reasonable contractual and technical protections limiting the use of that information to the Z-Force-specified purposes.
- We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share personal information with lawyers, law enforcement agents, or government agencies when we believe it is necessary to comply with the law, to prevent fraud or other illegal activity, or to prevent imminent bodily harm.
- If our corporate structure were to change, for example, if the company is sold or merged with another company, your user information may be transferred to a new entity. Should such a transfer occur, we will require that the new entity receiving your information follow this privacy policy with respect to your personal information unless the new entity first informs you of a change in the policy.
What Usage Information Does Company Collect?
Company employs web browser cookies and similar usage tracking technologies to collect and aggregate general information about users, including but not limited to their information such as IP address, the type of web browser used, web pages viewed, and other information. We may also employ web browser cookies and similar technologies in order to assist in processing your order if you make a purchase or to remember information for a future visit, including personal customization of the Z-Force experience. Except where necessary in order to complete a purchase, to maintain your screen name and power animal or to retain customizations, our cookies and similar technologies do not collect personally identifiable information. The aggregate information we collect via cookies and similar technologies may be combined with aggregate information of other users and analyzed. This information may include some or all of the following items:
- The Internet protocol address of your Internet service provider and your computer, if you have your own static address.
- The domain name of your Internet service provider.
- The date, time, length of stay, and specific Z-force webpages, images, videos or forms accessed.
- Whether you are visiting Z-Force for the first time or are a repeat visitor.
- The webpage/website that referred you to Z-Force.
- The search engine that referred you to Z-Force, including the specific search string or phrase entered into the search engine to find Z-Force.
- Demographic information concerning your country of origin, including your language.
- The type and version of the Internet browser that you use to visit Z-Force, the type and version of your operating system, and information regarding any errors that you experience on Z-Force.
You may be able to reject cookies or otherwise disable the collection of usage information via the settings in your web browser, but doing so may make some functions of Z-Force not work as well as they would if you allow cookies and the collection of usage information.
This Privacy Policy in no way restricts or limits our collection and use of aggregate usage information, which may be shared with third parties without your consent.
Does This Privacy Policy Cover Information You Provide in Association with a Digital Millennium Copyright Act (“DMCA”) Notification or Counter-notification?
No, this Privacy Policy does not apply to information you provide to us in association with a DMCA notification or counter-notification. All information contained in or associated with a DMCA notification may be provided to the alleged infringer. All information contained in or associated with a DMCA counter-notification may be provided to the initial claimant. Transmission of Information to United States Servers
If you use Z-Force outside of the United States, personal information may be transferred to servers inside the United States and maintained indefinitely. If you are in the European Economic Area, you should be aware that this may involve the transfer of information out of countries located in the European Economic Area and to the
United States. By accessing and using Z-Force, you agree and consent to such transfer and processing of your data.
Links to Third Parties
Z-Force may contain links to other services and websites. Should you access other services and websites through these links, you may be providing information directly to the other services and websites. We are not responsible for the privacy practices of other services and websites. We encourage our users to read the privacy statements of each and every service and website that collects personal information.
Your California Privacy Rights
FOR RESIDENTS OF THE STATE OF CALIFORNIA ONLY. Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of your personal information with third parties. If you reside in California and have provided your personal information to Company, you may request information about whether Company makes disclosures of certain categories of personal information to third parties for direct marketing purposes.
